If you somehow run into the 1% of the 25nl population who have a 4 bet range so tight that you can't profitably shove QQ (basically KK+) then the mistake was made with the 3 bet.

I'd say his range is far wider than that, more like: 22-JJ, 45s-T9s, Axs, KQ/QJ/QT/KJ/KT/TJ, damn near any two spades, some total random air, and pretty much never AA/KK/AK/AQ.
