The fact that DOJ knows that they can't win in court - or at least isn't sure to - but they took such dramatic action where there was no victim - is just evidence of the fact that this whole action was motivated by the desire to clear the US market for the powerful interests that control our politicians - and those powerful people want the US market for themselves. They were never going to outcompete Pokerstars for the US market so they used the DOJ to shut them out. Senator Kyl's change in view toward online poker is just further evidence that the fix is in. Now, this is good news for online poker players who will get to play eventually. But it sickens me because it is so unjust and Pokerstars should not be getting screwed over when they have run a great company.

Direct deposit/bank wire from pokerstars made the day it was first allowed hit today (in US). It seems whatever method they are using is working.

The DOJ has like a 96% success rate for convictions with these indictments--I don't recall the actual number but it was discussed numerous times in the Poker Beat when that podcast still existed. I don't think they made their move here on a flimsy evidence.

Does this include the times when they reach a settlement out of court, or when the defendants plead to a lesser charge to avoid months, even years of time and money in court?

Also the DOJ probably simply drops many cases that it thinks it will lose. They can usually get the defendants to make it a mutual decision. I know from personal experience that lawyers are so concerned about their win rate that they'll drop a case a day before trial just for the sake of not endangering the intimidation effect that their winrate provides.

I'm pretty sure the DOJ doesn't want to have to fight an uphill battle with the burden of proof on them, and the poker sites don't want to lose a case and damage any future they have at having US players play on their sites, they are probably just going to settle out of court.

PartyPoker settled out of court with the DOJ back in the day for $300 million.
