I think this is extremely opponent dependent. What people do here varies a lot. With some players I could have 40% against their betting range, others 20%. The problem is the spot doesn't come up that often so it's hard to get a read.

So draw one now? I figured that catching a second 8 made it more likely he had something like a 97. He could have T9 I suppose, or of course one of the two remaining 8's.

Yes.
I drew two and made a rather dirty number seven. He checked, I obviously bet, he had 98763 so I would have been drawing live if I'd drawn one. I neglected to factor in that he was in the BB and would have a rougher range.
